Playing Three-Dimensional Chess: Choice of Law in International IP Arbitration

Choice of law in international IP arbitration is a complex area. One author has compared it to a game of three-dimensional chess. How does an arbitral tribunal decide what law to apply in the absence of a choice of law by the parties? How will the tribunal's decision be limited by mandatory rules of national law? What are the limits of the parties' freedom to choose their own law? What are the emerging approaches to conflict of laws in the IP area specifically? In this presentation, Theodore J. Folkman and David Lee Evans of Murphy & King, authors of a forthcoming piece on choice of law in international IP arbitration, will provide an overview.
