Broker-dealers are increasingly utilizing digital engagement practices to interact with existing and prospective customers. Join our expert panel for a discussion on digital engagement practices, including gamification, current regulatory issues raised by digital engagement practices, and possible future regulatory responses.

The panelists will cover the range of digital engagement practices, including behavioral prompts, differential marketing, game-like features (commonly referred to as gamification), and other design elements or features designed to engage with retail investors on digital platforms (e.g., websites, portals, and applications), as well as the analytical and technological tools and methods.

They will also focus on gamification, which may currently be the most controversial type of digital engagement practice. While it can be used to help provide investors with information to make decisions, it can also be used to influence investors to remain engaged with a platform – features include push notifications, leader boards, confetti and scratch-off tickets that may award stock to users. Gamification has drawn increasing scrutiny from regulators ranging from the Massachusetts Securities Division to the SEC and FINRA.
