Surveys provide invaluable insight into consumer beliefs and attitudes and have long been relied on by courts as key evidence in IP cases. Survey evidence is routinely used to prove infringement in trademark and trade dress cases, liability in false advertising and other Lanham Act claims, as well as quantify damages in these and other IP cases, including patent litigation. In this program, hear from a panel of experienced survey experts on the nuts and bolts of how to assemble a team, how to work effectively with your experts to design and execute surveys for litigation, how to avoid common pitfalls and risks, and current trends in the courts.
