2020 has seen a monumental shift in Americans’ conception of privacy. Social media sites are under pressure for what they collect, how they use and share information about us, and the ways that they use that information to shape opinions in an election year. Our phones and connected devices now regularly collect health data and are capable of extraordinary monitoring (e.g., for COVID-19 tracing). Proposed facial recognition technology bans aim to address the potential for hard-coding discrimination into technology. And states are considering, and in some notable cases, enacting and enforcing relatively comprehensive privacy legislation. How do we create a law that allows for advances in industry and technology while addressing consumer and other concerns?
