This four-hour CLE course complements the
introductory session on Mediation for Consumer Bankruptcy Cases offered on
September 16, 2020, which can be viewed here.
This session offers a deeper dive into the topic through
the perspectives of an experienced panel which includes two former federal
bankruptcy judges. The session will build on the fundamental concepts
explained in the prior session through role-playing and facilitated
discussion. While attendees are encouraged to review the prior session,
doing so is not mandatory. Participants should come willing to learn how
to help consumer and small business clients solve financial problems in and out
of court using mediation skills.
In particular, participants will learn how mediation can
be used to resolve nondischargability, automatic stay, plan confirmation and
other common issues arising in financially distressed circumstances.
Attendees will help identify and resolve issues involving a fictional couple who
not only commence an individual chapter 7 proceeding but who also commence a
chapter 11 case for their business. Participants will learn
how to help clients satisfy key interests, identify options, assess alternatives
and reach resolutions that may not be achievable within the position-based
framework of a judicial proceeding. With the economic consequences
of COVID-19 for many looming large, now is the time to learn more about
mediation and how it can be used to assist consumer and small business debtors.
