Educating and Training the Next Generation of Investment Management Lawyers in a Rapidly Changing Industry

The program is about the challenges of teaching investment management law and how the mix of topics and legal concepts to be mastered by practitioners in the industry has changed over the last twenty years and is likely to change going forward.  The two discussion leaders will share their own different, though overlapping, perspectives and invite discussion.  As part of the discussion, practitioners at law firms, asset management firms and regulatory agencies will be invited to examine their roles in shaping the professional development of investment management lawyers and explore how they and law schools may better prepare the next generation lawyers for the difficult task of practicing in this dynamic industry.     

Industry changes offer an opportunity to frame this discussion more concretely.  While fiduciary principles and managing conflicts of interest continue to be cornerstones of the regulatory framework, seasoned practitioners and new lawyers are challenged by topics that may have been unknown or not fully appreciated a generation ago.  Examples of topics illustrating these challenges and touchstones for the discussion include:

• New business concepts relevant to industry literacy:
o Passive versus active strategies 
o The rise of ETFs and related products
o Methods for measuring and evaluating performance and risk
o Impact of technology on the delivery of personalized investment advice

• New legal perspectives on: 
o Compliance
o Disclosure in a social media age
o The evolving role of independent trustees
o Reconciling brokerage and advisory models in serving retail investors
o Transparency of private funds through federal registration of private fund advisers
