Cutting Edge Topics in Federal Class Action Procedure

In the wake of a series of groundbreaking Supreme Court decisions on class action procedure, we will host a brown bag lunch to address:

  • A review of 2019 Supreme Court case law, including:
    Lamps Plus, Inc. v. Varela (U.S. 2019) (contract must unambiguously require class arbitration for it to occur)
    Henry Schein Inc. v. Archer and White Sales Inc. (U.S. 2019) (where parties agree that arbitrator will assesses arbitrability, arbitrator, not court, must do so even as to “wholly groundless” arguments)
    Home Depot U.S.A. Inc. v. Jackson (US 2019) (third-party counterclaim defendants cannot remove class actions under the federal removal statute)
    Frank v. Gaos (U.S. 2019) (taking up but not deciding validity of cy pres settlement)
  • Sample arbitration clauses
  • Lower court application of recent Supreme Court precedent, including personal jurisdiction issues for federal class actions
  • Predominance-related issues following the First Circuit’s decision in In re Asacol Antitrust Litig.
  • Cy pres class action settlements
  • Recent changes to the Federal Rules of Civil Procedure affecting class actions
  • Analogous developments under Massachusetts Rules of Civil Procedure
