After a decade in gestation, new M.G.L. c. 149 § 24L – with important
protections and guidance for employers and employees in widely-used non-compete
agreements (NCAs) between them – was passed unanimously by the General
Court, was signed into law by Governor Baker on August 10, 2018, and will be
effective October 1, 2018. Enacted with it were M.G.L. c. 93 §§ 42-42G,
the Uniform Trade Secrets Act, enacted in 48 other States, “tweaked” by the
first intellectual property law committee of the BBA in 1992-94 and introduced
in every General Court since.
