The National Monuments Cases

The panelists will discuss the structure and operation of the Antiquities Act and recent litigation relating to the Act. The panelists will discuss lawsuits challenging the President’s power to alter or shrink the boundaries of national monuments created by his predecessors, including the Bears Ears and Grand Staircase-Escalante monuments in Utah. The panelists will also discuss legal challenges to the President’s power to create monuments in the first place, including a challenge to President Obama’s creation of the Northeast Canyons and Seamounts National Monument by a group of New England fishermen.
