Cybersecurity in Arbitration

Malicious cyberattacks and data breaches have become a daily occurrence for modern businesses.  With millions or even billions of dollars on the line when parties resolve their disputes through arbitration, and with data flowing between parties, arbitrators, and institutions, there is growing concern that cybersecurity threats can compromise the arbitral process, leading to unauthorized disclosures, breaches of attorney-client confidentiality, and legal liability.

We assembled a distinguished group to discuss this critical issue, with representatives from institutions (Olivier André, Vice President, International and Dispute Resolution at the International Institute for Conflict Prevention and Resolution (“CPR”)), arbitrators (Conna Weiner, Independent Arbitrator and Mediator; CPR Distinguished Neutral), corporate users (Sharon Jones, Senior Counsel—Litigation for Raytheon Company), and outside counsel (Jared Hubbard, Fitch Law Partners, LLP).  Listen as each describe the cybersecurity issues at play in arbitration today, as well as what best practices are for preventing cybersecurity problems. 

This event will also be an opportunity to discuss the draft cybersecurity protocol for international arbitration recently released by a Working Group formed by the International Council for Commercial Arbitration, together with the International Institute for Conflict Prevention and Resolution (CPR) and the New York City Bar Association.  The draft Protocol is meant to raise awareness about cybersecurity risks and to propose a framework that parties and arbitrators can look to in order to determine reasonable cybersecurity measures for their arbitrations.
