SLAPP Happy Redux: The anti-SLAPP Statute One Year After Blanchard

On May 23, 2017, the Supreme Judicial Court, in Blanchard v. Steward Carney Hospital, Inc., announced the adoption of the “augmented Duracraft framework” to decide special motions to dismiss under the anti-SLAPP statute.  This panel will examine how the anti-SLAPP landscape has evolved in the year since the Supreme Judicial Court’s decision in Blanchard.  Topics of discussion will include:

  • How did we get here?
  • What concerns led to the adoption of the augmented Duracraft framework?
  • The application of the Blanchard standard by lower courts
  • Whether, and if so, how, the decision to bring a special motion to dismiss under the anti-SLAPP statute has changed after Blanchard
  • Practice tips on effectively bringing and opposing special motions to dismiss under the Blanchard standard
  • The future of the anti-SLAPP statute and the augmented Duracraft framework
  • Proposed legislative fixes to the anti-SLAPP statute
