Description:

When confronted with an employee complaint or an incident of misconduct, it is likely that an employer will need to conduct an investigation into what happened. In the context of complaints of harassment or discrimination in the workplace, an employer has an obligation to investigate the matter and take appropriate remedial action.

Recent decisions highlight that the manner and scope of an investigation can impact an employer’s potential liability for the underlying incident. But every investigation raises a number of thorny issues. From the employer’s perspective, it has to decide whether to conduct an investigation at all, and, if so, who should conduct the investigation. If an attorney is involved, the employer needs to consider whether the investigation is intended to be privileged and should it be. Further, the employer needs to think about the scope of the investigation and its timing. Employees who raise a complaint or participate in an investigation will have concerns about confidentiality and protection against retaliation. Complainants must also decide whether to wait out the employer’s investigation or proceed to filing an administrative charge. If the investigation implicates potentially criminal conduct or professional licensure issues, employees who are the subject of the investigation may have to decide whether to cooperate with the investigation.

This program will explore these and other issues that can arise in every workplace investigation. The panel will offer their perspectives on how to conduct an investigation that is effective and protective of the interests of both employers and employees.
