CLE - Advanced Issues in Mediating Business Disputes

Business disputes are often complex, and challenging issues tend to arise in mediating business controversies:

  • How does the background of the business mediator you choose send signals and influence the mediation process?
  • What is the best way to structure a mediation statement to have the most impact?
  • How does one successfully use experts or “defend” against their use?
  • What are the best ways to handle multi-party situations?
  • What considerations are involved with a mandatory mediation that was previously stipulated to by party agreement?
  • How are facilitative and evaluative approaches balanced throughout the mediation process?
  • What are the benefits and drawbacks of involving a “mediator’s proposal” to resolve disputes?

An esteemed and experienced panel of the Hon. Margaret R. Hinkle (Ret.) (JAMS), Brad Honoroff (The Mediation Group), and the Hon. Stephen E. Neel (Ret.) (JAMS) will discuss these topics and others.

The program will be moderated by E. Abim Thomas, partner at Goodwin Procter LLP, and Brendan T. St. Amant , partner at Donnelly, Conroy & Gelhaar LLP.
