CLE - Allocating Environmental Risks in Transactions

Description:

Environmental risks in real estate and corporate transactions are a concern for property owners, buyers and lenders.  Appropriately managed due diligence and risk allocation can be critical to successful deals and help you and your clients avoid unhappy surprises after transactions are done.  This program will prepare you for:

  • Performing due diligence, including evaluating exposure to statutory and common law liability, complicated regulations, state and federal agency enforcement, and clean-up costs;
  • Evaluating the implications of Massachusetts’ new regulations and guidance for vapor intrusion;
  • Developing strategies to mitigate exposure to environmental liabilities, including the use of contract language and insurance policies; and
  • Reporting environmental risks to the Securities Exchange Commission.

Join us to learn about tools for managing exposure to environmental liabilities and to examine the statutory and regulatory framework that drives environmental due diligence in real estate and corporate transactions.
