Damages on Trial: What Insulet Means for Trade Secrets Litigation
This keynote examines the landmark Insulet Corporation v. EOFlow decision, in which a jury found willful trade secret misappropriation and the court ultimately entered a worldwide permanent injunction while affirming the verdict in full. Focusing on the court’s post-trial rulings, Goodwin’s lead litigator from the case will discuss the interplay between damages and injunctive relief, including the reduction of a $452 million verdict to a $60 million award paired with injunctive relief. The case offers a powerful lens on how courts are calibrating trade secrets damages, equitable relief, and deterrence in high-stakes IP litigation.
