Education About Voting Rights
The Boston Area Universities Election Improvement Project is attempting to implement real-world programs that improve the electoral process and increase understanding of voting behavior. The Project has two primary facets, the first focusing on vote administration and the voter experience, the second focusing on program evaluation and statistical techniques. Beyond this information being of interest on its own, it will also facilitate the study of quantitative methods used to understand voting behavior, such as might be used in voting rights analysis. These new methods would be designed to replace current techniques used in, among other places, federal courts.Co-sponsored with Boston Area Colleges Elections Improvement Project, ACLUM Science and Technology Committee, and the American Constitution Society.

We will discuss how to structure CLATs, the tax consequences of CLATs, and how to draft CLATs in light of the new IRS forms. We will also discuss planning opportunities and the circumstances in which charitable lead trusts may be useful for your clients.

Presentation of Evidence and Monopoly Power in Patent Infringement Suits

Michelle Miller and Mark Ford of WilmerHale LLP will give a presentation on their representation of Braintree Laboratories, Inc. in a recent bench trial before Judge Sue Robinson of the District of Delaware. Braintree Labs., Inc. v. Schwarz Pharma, Inc., Civ. A. No. 03-477-SLR (D. Del.). Braintree was accused of bringing a sham patent infringement suit to block generic entry and maintain its alleged monopoly in a single product market. The case is awaiting judgment. The discussion will cover the presentation of evidence concerning the relevant market, monopoly power, and damages.

FASB Statement 141R Presentation
Peter Resnick, Steve Burlone, Robert Fraga, Brian Christie, and James Dondero of Huron Consulting Group will discuss SFAS 141R and the dramatic impact it will have on how acquisitions are accounted for. SFAS 141R is effective for transactions closing on or after January 1, 2009 for calendar year companies, so the new rules will need to be considered for transactions that are structured during 2008 but not closing until 2009.
