Civil Discovery in Massachusetts: Developments 2005

This program will provide an update on civil discovery practice in the Massachusetts state courts, including a review of changes in the rules, the new civil Time Standards, and recent decisions interpreting the Massachusetts discovery rules.

Attendees will gain a solid understanding of new developments in the law of privileges, the effects on discovery of the new civil Time Standards, obtaining examinations of parties by experts other than physicians, and recent decisions on sanctions.

 Specific topics will include:

  • How the new Standing Orders adopted by the Trial Courts are affecting discovery practice
  • Whether a judge will seal material under the Uniform Rules on Impoundment
  • Whether a lawyer may invoke the work product doctrine against his own client, and other developments in the privileges recognized under G.L. c. 233
  • When a judge will order production of psychotherapy records in a civil case
  • If and when a judge will order expert depositions
  • Recent decisions on discovery sanctions
